1. Nature of the Platform
Autos de América operates as a digital marketplace that allows users to publish vehicles and communicate with each other. The platform acts exclusively as a technology intermediary.
2. No Transaction Participation
Autos de América does not buy, sell, inspect, or guarantee the vehicles listed on the platform. The platform does not participate in the negotiation, inspection, or transfer of ownership of listed vehicles.
Any purchase agreement made between users is the exclusive responsibility of the parties involved.
3. User Responsibility
Users are responsible for the accuracy of the information published in their listings. False, misleading, or fraudulent information will result in listing removal and possible account suspension.
4. Fraud Prevention
Autos de América implements identity verification processes to improve platform security. However, it cannot guarantee the absolute authenticity of all users.
5. Reporting Suspicious Activity
Users can report suspicious activities using the reporting tools available on the platform. All reports are reviewed by our team within 24 hours (urgent) or 48 hours (general).
6. Verification Levels
The platform has three user levels:
- Level 1 — Basic user: Browse and explore the platform without an account.
- Level 2 — Verified user: Can buy and sell vehicles. Requires identity verification (name, email, phone, ID photo, selfie with ID, date of birth, nationality).
- Level 3 — Agency: Access enabled through paid plans. Requires business name, legal name, business registration ID, legal representative, representative ID document, business address, business phone, and website or social media.
7. Agency Accounts
Each agency can have a maximum of 3 users with access to the account. Each person with access must have a Level 2 (verified user) account.
8. Applicable Legislation
These terms are governed by the laws of the Republic of Costa Rica, including Law No. 8968 on Personal Data Protection, Law No. 7472 on Competition Promotion and Consumer Defense, and the Costa Rica Commercial Code.
